I don’t think there’s anything wrong with that, especially if it includes unique elements. Time and skill are yours to do as you wish. I think you could, if you agree that you are selling your time and effort and skill. If you scratch build a model that looks like the real thing, can you sell it? This is especially true if the re-created model is formed with raw material construction (nothing from the commercial kit).
